Terms of Service

By clicking “I Agree”, creating an account, or using any part of the Vigur website, mobile experience, or services (collectively, the “Service”), you confirm that you have read, understood, and agree to be bound by these Terms of Service (“Agreement”). If you do not agree, do not use the Service.

If you accept this Agreement on behalf of another person—including a minor—you represent and warrant that you have full legal authority to do so.

If you are experiencing a medical emergency, call 911 immediately.
Vigur’s Service is not appropriate for all conditions and does not replace in-person care when clinically required.

Overview of the Service

Vigur Inc (“Vigur”, “we”, “our”) provides a performance-health platform combining diagnostics, telehealth consultations, personalized protocols, and prescription routing through third-party medical groups, independent providers, laboratories, and pharmacies (collectively, “Third-Party Clinical Partners”).

The Service includes:

Access to licensed healthcare providers via telehealth
Lab testing ordered and fulfilled by independent laboratories
Prescription fulfillment through third-party pharmacies
Non-prescription wellness products, Membership plans, and digital tools
Communications, results, recommendations, and personalized health plans

Your use of any medical, clinical, or diagnostic services delivered through the platform is governed by this Agreement. Vigur, however, is not a medical group, provider, laboratory, or pharmacy and does not practice medicine.

Your Relationship With Us

Vigur is a Technology & Service Platform—Not a Healthcare Provider

All medical services—including telehealth visits, diagnoses, prescriptions, lab orders, and clinical decisions—are delivered solely by independent, licensed providers or medical groups (“Providers”). These Providers are responsible for the clinical care they render.

Vigur does not control, supervise, or interfere with the practice of medicine.

Third-Party Clinical Partners

Providers, laboratories, and pharmacies are independent businesses. By using the Service, you authorize Vigur to share your information with these partners as needed to coordinate your care, prescriptions, and lab orders.

Communications

Providers may send you messages, results, instructions, or follow-ups through the Service. It is your responsibility to review and respond to these communications. Neither Vigur nor Providers are liable for consequences arising from your failure to do so.

Eligibility & Limited Use

You represent and warrant that:

You are at least 18 years old and located in a state where Vigur operates.
You will only consult with Providers while physically located in the state associated with your account details.
You will use the Service only for lawful purposes.
You will provide accurate, complete information.

The Service is not available to individuals under 18, except where legally allowed and expressly authorized by a parent or guardian.

Providers may determine that your condition requires in-person evaluation or is not appropriate for telehealth; in such cases you may be declined or referred to in-person care.

Telehealth Consent

Telehealth involves electronic communication between you and a Provider who is not in the same physical location. Risks include, but are not limited to: technology failures, incomplete data, or the need for in-person follow-up.

You must review and accept the Telehealth Informed Consent, which forms part of this Agreement. Vigur is a third-party beneficiary of that consent.

Financial Responsibility

Vigur, Providers, labs, and pharmacies do not participate in Medicare, Medicaid, or other government health programs.

By using the Service, you agree that:

All services and products are provided on a self-pay basis.
You will not submit claims for reimbursement to any federal or state healthcare program.
You are solely responsible for all fees associated with your care, Membership, labs, and prescriptions.

Memberships & Subscription Billing

Some Vigur offerings renew automatically. By enrolling in a Membership or subscription service, you authorize recurring charges to your designated payment method until you cancel.

Key terms:

Renewals may be processed up to two days early to maintain continuity of care.
You may cancel at any time; cancellations take effect at the end of the current billing cycle.
Partial period refunds are not provided, except at Vigur’s discretion.
Prices and plans may change; you will be notified in advance.

Subscriptions may include bundled charges for telehealth consults, labs, and pharmacy fulfillment.

Prescription Products

Prescription medications require a consultation and an independent Provider’s determination that the medication is appropriate.

You may:

Fill prescriptions via Vigur’s partnered pharmacies, or
Request that prescriptions be sent to a pharmacy of your choice.

If you choose an external pharmacy, you are responsible for the cost and logistics of filling that prescription.

Neither Vigur nor Providers guarantee medication availability, pricing, shipping times, or pharmacy packaging.

Laboratory Testing

Lab testing requires a Provider order. Tests are fulfilled exclusively by independent laboratories.

By using the Service, you agree:

To follow all instructions for sample collection and return.
That inadequate, late, or improperly handled specimens may yield invalid results.
That Vigur and Providers may contact you regarding abnormal or critical values.

Testing is intended for performance-health insights and may not diagnose all conditions. Some results may require in-person care or additional evaluations.

Refunds for unused testing may be granted only at Vigur’s discretion.

Privacy & Protected Health Information

Vigur is not a HIPAA “covered entity.” Some clinical partners may be.

Your data falls into two categories:

Personal information (e.g., contact details) governed by Vigur’s Privacy Policy.
Protected Health Information (“PHI”), which is governed by applicable state laws and—where applicable—HIPAA obligations of Providers, labs, or pharmacies.

By using the Service, you authorize:

Vigur to receive, store, and transmit your information to Providers, labs, and pharmacies.
Providers to access and use your PHI to deliver care.

Accounts, Security & User Responsibilities

You agree to:

Maintain accurate account information.
Keep your username and password secure.
Notify Vigur immediately of unauthorized access.
Log out after each session.

Vigur is not liable for losses arising from unauthorized account use.

Acceptable Use

You may not:

Use the Service for illegal or fraudulent purposes
Attempt to access systems or accounts that are not yours
Upload harmful, abusive, or infringing content
Interfere with Service operations
Mine data, scrape, or use automated tools
Reverse engineer or copy any part of the Service

Violations may result in account termination and legal action.

Third-Party Goods & Services

All clinical services, labs, and pharmacy products are provided by independent third parties.

Vigur is not responsible for:

The quality, availability, or safety of third-party services
Delays, errors, or omissions by providers, labs, or pharmacies
Any disputes between you and a third party

You release Vigur from claims arising from third-party actions.

Disclaimers

The Service is provided “as is” and “as available.”

Vigur disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee:

Accuracy or completeness of content
Continuous or error-free operation
Prevention of cyberattacks or unauthorized access

Use of the Service is at your sole risk.

Limitation of Liability

To the fullest extent permitted by law:

Vigur is not liable for indirect, incidental, consequential, punitive, or special damages.
Vigur’s maximum aggregate liability for any claim is $1,000.

Claims must be brought within one year of the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Vigur, Providers, labs, pharmacies, and their affiliates from claims arising out of:

Your use of the Service
Your breach of this Agreement
Your violation of laws or third-party rights

Electronic Communications & SMS Opt-In

By creating an account, you consent to receive:

Emails
Text messages
Notifications via the platform

These communications may include appointment reminders, lab updates, prescription notices, Membership information, and offers.

Message and data rates may apply. You may opt out of SMS at any time by replying STOP.

Termination

Vigur may suspend or terminate your access at any time, including for violations of this Agreement or due to discontinuation of the Service.

You may not create a new account if your prior access was terminated.

Arbitration & Class Action Waiver

Binding Arbitration Required.

Unless you opt out within 30 days of accepting this Agreement:

All disputes between you and Vigur will be resolved by binding arbitration, not in court.
You waive the right to a jury trial.
You waive the right to participate in class actions or class arbitration.

Arbitration will be conducted by NAM under its rules.

You may opt out by sending a signed notice within 30 days to:

Governing Law

This Agreement is governed by the laws of Nevada, unless superseded by applicable federal law. Arbitration venue and any court proceedings (where applicable) will occur in Clark County, Nevada.

Assignment

You may not transfer your rights under this Agreement.
Vigur may assign its rights to an affiliate or successor without notice.
